The case against 18 defendants, including the murder of writer Musa Anter in 1992 and the injury of AK Party MKYK Member Orhan Miroğlu, and Mahmut Yıldırım, codenamed “Yeşil”, who was held responsible for some actions, was dropped on the grounds of the statute of limitations.
While the defendants did not attend the hearing at the Ankara 6th High Criminal Court, the defendant and his intervening lawyers, HDP Co-Chair Mithat Sancar and some deputies were present in the hall.
The President of the Court made a promise to the parties after reading the documents in the case file.
The lawyers of the complainant demanded that the case not be concluded due to the “time-out”, that the file be considered as a “crime against humanity” and that it be exempted from the deadline.
The defendant’s lawyers also demanded the implementation of the “time-out” decision.
In his opinion, the public prosecutor demanded that the public case regarding the killing of Musa Anter and Ayten Öztürk and the injury of Orhan Miroğlu be dismissed as the statute of limitations had expired.
The prosecutor demanded that the “JITEM case”, which was heard at the Diyarbakır 1st Heavy Penal Court, including Mahmut Yıldırım, code-named “Yeşil”, and which was later merged with the case file, to be separated from the file.
Announcing its decision after the statements, the court decided in line with the prosecutor’s opinion and decided to drop the case on the grounds of “timeout”.
The court ruled that the “JITEM case” with 16 defendants, whose crime date was 1996, merged with the case file in the previous hearings, to be separated.

HDP Co-Chair Mithat Sancar, who made a press statement in front of the courthouse after the hearing, said that the decision to drop was unlawful and that this situation was not a surprise to them.
Stating that the Anter murder is within the scope of “crimes against humanity” according to universal law and the European Convention on Human Rights, Sancar stated that they will still follow all the unsolved cases, especially the Anter murder.
The lawsuit regarding the attack that resulted in Anter’s death and Miroğlu’s injury was filed in Diyarbakır, and was transferred to Ankara for security reasons.
In the indictment, it was claimed that Mahmut Yıldırım planned and directed the action, that Hamit Yıldırım carried out the action, and that then Gendarmerie Intelligence Group Deputy Commander Savaş Gevrekçi appointed Abdülkadir Aygan, who was under his command, to help the perpetrators.
In addition to aggravated life imprisonment for “willful murder”, the defendants were also asked to be punished for “inciting the people to rebellion and encouraging them to strike against each other” and “injuring people”.
Two months after Ayten Öztürk’s disappearance in 1992, the JİTEM case with 16 defendants at the Diyarbakır 1st High Criminal Court, including Mahmut Yıldırım and Abdülkadir Aygan, was brought before the Elazığ 1st High Criminal Court. The case concerning the finding of dead was also combined with the case concerning Anter and Miroğlu.
