Painful father: This would not have been death if he had not been detained

Ayşe Özgecan Usta, father of Ayşe Özgecan Usta, who jumped from the terrace in her lover’s house on the 8th floor in Zonguldak, said, “I think the person lied. He detained my daughter. If he hadn’t, this death would not have happened.”

The incident occurred on February 5, 2021 in İncivez Mahallesi, Major Tahsin Street. Ayşe Özgecan Usta came from Ankara to her boyfriend Bartu Can Akkışla, who lives in Zonguldak. Allegedly, an argument broke out when Akkışla responded negatively to the Master’s request to marry in a short time. As the argument escalated, the Master said to his boyfriend, “I’m going to throw myself,” and headed for the terrace.

FALL FROM THE TERRACE, SERIOUSLY INJURED, DIED IN HOSPITAL

Her boyfriend went up to her and tried to hold her back, but was unsuccessful. Master, who was seriously injured by falling from the terrace of the flat on the 8th floor, died in the hospital where he was taken. After the incident, Bartu Can Akkışla was detained. In his statement, Akkışla said that they had been arguing about marriage, that the Master went to the terrace, tried to hold it, but could not save it.

HOME PRISONMENT TURNED INTO JUDICIAL CONTROL MEASURE

It was decided to apply an electronic handcuff to Akkışla and to apply a house arrest measure. The house arrest sentence was later converted to a judicial control measure. After the investigation, an indictment was prepared and a lawsuit was filed at the Zonguldak 2nd Criminal Court of First Instance.

“Crime of Causing Death by Negligence”

In the indictment, it was stated that the defendant should have foreseen that the Master would commit suicide. In the indictment, which states that the master went to the terrace saying “I will throw myself”, but Akkışla did not go immediately, a prison sentence of 2 years to 6 years was demanded for the accused “for causing death by negligence”.

The case at the Zonguldak 2nd Criminal Court of First Instance continued. While Özgecan Usta’s family and lawyers were present at the hearing, the pending defendant was connected to the hall through SEGBİS from the Çaycuma Courthouse.

She got angry, she said she was going to leave the house. It was past 12 o’clock, there was a curfew. Alcoholic, she was going to travel 300 kilometers. I tried to persuade. She took quick laps in the hall. I was trying to calm down. He came out to the terrace saying ‘I’m going to throw myself.’ I said, ‘My wife is not at home.’ I said, ‘Let’s cut the nets, maybe we can get one.’

ASKED HOW THE PHONE WAS BROKEN

It was recorded that Özgecan Usta used two phones, one on Akkışla on the day of the incident, and the other was found in a broken bag in the bedroom by the crime scene investigation team, and Akkışla was asked why Usta’s phone was in him and how the other phone was broken. Akkışla replied, “While he was panicking, I took everything on the table and went downstairs. He hit the table and broke it by saying I don’t want anything from you.”

“WE WERE TOGETHER TO GO ON HOLIDAY”

When asked why the Master’s suitcase was packed, he said, “We were already together because we were going on vacation. When he said ‘I will go’ in the evening, he gathered well. I tried to persuade him by saying, ‘There is a ban, you are drunk.'”

While the judge explained that the phones of Usta and Akkışla were examined, but the code of the broken phone could not be deciphered, the contents could not be examined, while some of the messages between the two were read. After the judge said that Akkışla did not give satisfactory answers to Özgecan Usta’s request for marriage and the discussions in this context, Akkışla said, “I wanted Özgecan’s education to be his education. I wanted him to sit on solid ground.”

FATHER BLASTED HIS BREAK AND SAID “COOL MY HEART”

Father Kenan Usta started his speech by criticizing Akkışla’s lying and criticizing the investigation prosecutor. Saying that his daughter died because she was not allowed to leave the house on the day of the incident, Kenan Usta said, “He blocked my daughter because she was drunk and there was a curfew. If she did, the police would catch her, give a fine, take action, or die in an accident, we would have suffered too. She also broke the phone herself. “I want it to be reorganized and prepared. I don’t trust that prosecutor. I’m asking you, how would you feel if you had your own child and weren’t arrested? I want this person to see the prison. Don’t let him wander around with his hand waving, put him to bed until his sentence is clear,” he said. Kenan Usta, hitting his chest, said “cool down here, my heart is burning, cool my heart”.

When asked about the claim that he broke the phone, the accused Bartu Can Akkışla said, “There are mistakes in what Uncle Kenan said. The family is in pain, I have pain too. I did not break the phone.

Continuing his speech, Kenan Usta said, “This person did not let my daughter go. ‘ he said.

“I HEARD ÖZGE SAY ‘I’M FALLING DRAW'”

On the day of the incident, Bartu Can Akkışla’s neighbor SG, who lived on the ground floor, was heard as a witness. He said that he heard the sound of arguing at night on the day of the incident, and then a different, loud crying sound came from the bathroom. SG stated that Akkışla was a noisy neighbor and they thought they were fighting again and said that he saw someone hanging on the balcony while he was going out to get the fruits because there was a storm.

Stating that Akkışla asked for help and told him to get the net, SG said, “When I was going to buy a knife to cut the net, I heard Özge say ‘I’m falling, pull it up’. Then he heard the sound of divorce and banging. Bartu was shouting, ‘My God, how will I hold on’.”

ADDITIONAL CLAIM IS DEMANDED FOR RETENTION

Özgecan Usta’s family’s lawyer, Ezgi Aybüke Dizlek, requested an additional indictment for detention and said, “If I said I was going to jump on someone and he came after me in 3 seconds, he would have caught me before I could reach the railings. We want the house and neighborhood where the incident took place to be explored and enlightened. we do,” he said.

DECIDED TO MAKE A DISCOVERY

While the defendant’s lawyer opposed the request for detention, he requested that his client be exempted from the hearing. While the judge refused Bartu Can Akkışla’s request to be exempted from the hearings, he tightened up the judicial control measures applied to the accused. While it was decided to make a discovery, the hearing was adjourned to make up for the missing issues. It was also stated that the crime of detention will be evaluated.

Kenan Usta, who made a statement at the exit of the court, stated that they did not trust the investigation prosecutor. Stating that his daughter took out a loan to buy a phone, they learned after her death, Usta said that the phone was found at home and said, “I bought the phone.” struck broke.’ Then Özge takes that phone and puts it in a bag.
