The U.S. Supreme Court is set to rescind a nationwide legal right to have an abortion, according to an unprecedented leak of a court document.
In a 98-page draft, Justice Samuel Alito writes that Rowe Wade’s decision of 1973 to legalize abortion across the United States was “extremely wrong.”
If the U.S. Supreme Court overturns the ruling, “trigger laws” would immediately make abortion illegal in 22 U.S. states.
Judges are not expected to issue a verdict until early July.
The 1973 law is in the court’s view because it challenges the Mississippi ban on abortion after 15 weeks, which the judges asked in December.
But Roe v Wade comes under threat at a time when reproductive rights are being threatened in Republican leaning states around the United States.
This provoked an immediate outcry from Democrats, and opposition – both pro-abortion and anti-abortion supporters – outside the Supreme Court on Monday night.
Speaker of the House of Representatives Nancy Pelosi and Senate Majority Leader Chuck Schumer – both Democrats – issued a joint statement saying that if the report was accurate, “the Supreme Court is ready to impose the largest restrictions in the last 50 years.”
The news agency Politico quoted Judge Alito as saying: “Row was very wrong from the beginning.
“Instead of bringing a national solution to the abortion issue, Roe and Casey have provoked controversy and deepened divisions.”
Neither the Supreme Court nor the White House has commented on the leak.
Consider for a moment that this draft concept will become the law of the land. In a moment – because of the laws already in the books and the “trigger” laws designed for such an occasion – abortion is illegal in 22 states.
The legitimacy of this practice in the middle of an election year will turn into a vicious political battlefield.
This is also the significance that can emerge in the Supreme Court.
However, draft ideas are just that – drafts. There are accounts of judges changing their views when the opinion-drafting process comes out within the courtroom. All of these unprecedented leak short circuits.
For much of American history, the Supreme Court has acted like Mount Olympus and provided opinions from the top. As the leak spreads, that opacity is broken.
It remains to be seen what the legitimacy of the judicial process in the United States will mean, but it is safe to assume that all trust between the judiciary and a collective body of so-called “brothers” is gone. .
At a time when political norms are being broken like pottery in an earthquake, another big piece has fallen.
Six of the nine judges currently on the court are appointed by Republican presidents. The other three were elected by Democratic leaders.
Judge Alito and four other Republican-appointed judges – Clarence Thomas, Neil Korsch, Brett Kavanagh and Amy Connie Barrett – were in favor of the move against Rowe Wade, but it was unclear how Chief Justice John Roberts would vote.
The leaked document is marked “1st draft” and was distributed in February, according to Politico.
If the majority verdict is issued, Judge Alito’s opinion will nullify the constitutional right to abortion in the United States, paving the way for individual states to ban the practice altogether or impose more restrictions on it.
The U.S. Civil Liberties Union said the decision, if confirmed, would “rob the nation of half of the basic, constitutional rights enjoyed by millions of women for more than 50 years.”
