Tesla sues civil rights agency for racial bias lawsuit • CableFree TV

Tesla couldn’t get the judge to drop the case alleging racial bias at the automaker’s Fremont plant last month, so now the automaker is filing a counterclaim against the agency responsible.

The luxury electric car maker filed a complaint in Alameda County state court on Thursday, saying the California Civil Rights Department (CRD) adopted “underground rules” in its investigations into the Tesla plant. DCR originally sued Tesla in February. following accusations of racial segregation in the workplace, where black workers were subjected to abuse, harassment, unequal pay, and a hostile work environment.

Since the lawsuit was filed, Tesla has attempted to unsuccessfullyto have the case dismissed for the same reasons it is now countersuing with CRD. In Tesla v. CRD, the automaker alleges that the agency did not first notify Tesla of claims or racial discrimination at its plant and did not give the company an opportunity to settle the dispute out of court.

The company alleges that CRD violated state law by failing to seek public opinion prior to enacting procedures for investigating and filing a lawsuit against employers. In June, Tesla also filed a petition with the Office of Administrative Law. for the same reasons in an attempt to limit CRD’s powers by insisting that it take additional steps before suing employers.

Tesla is now using this lawsuit to try to stop CRD from following its allegedly illegal procedures in investigating any employer. The lawsuit also hopes to force the agency to pass the new rules through a formal rule-making process.

But it’s not all for the benefit of future employers against whom the agency is suing. The complaint could give Tesla’s lawyers insight into CRD’s practices as well as its investigations into Tesla, which could then help Tesla’s efforts to drop the original case.

CRD did not immediately respond to a TechCrunch request for comment.
