Tax authorities and the Central Bank will look at the frequency and geography of money transfers from Russians to determine which ones could be considered illegal

The Federal Tax Service (FTS) and the Bank of Russia are discussing a list of criteria by which, in automatic control mode, they will determine the income of Russians received from undeclared business activities, RBC writes with reference to two sources (access is paid via the link, the material is retold at Frank Media).

The criteria for classifying transfers as commercial activities include the following:

  • The frequency of transfers that will be taken care of “first and foremost” (it is not specified how many payments and for what period will be considered suspicious).
  • Geography of remittances – for example, regular interregional payments could be considered business income.
  • Timing of transfers – Tax authorities will consider payments collected during business hours.

According to one of RBC’s sources, these standards will not apply to self-transfers, as well as to payments between close relatives. This concept will be expanded as much as possible, RBC wrote – and may include people who are in a civil marriage with the sender or the recipient.

At the end of March, it became known that the Ministry of Finance prepared a draft law to expand the continuous exchange of data between the Federal Tax Service and the Bank of Russia. As part of this project, the agency wants to introduce automatic control of the income of Russians in order to identify commercial activities disguised as ordinary money transfers. The Federal Tax Service explained that the “starting point” for such control will be an increase in income of 2.4 million rubles per year (200 thousand per month). The bell malethat a large portion of remittances are now not actually subject to tax, and in practice are often disguised as payments for services, rent or goods.
