As lawyer Ilya Frolov told VM, if parts of feature films or documentaries indicate facts that do not correspond to reality and offend the honor and dignity of people, relatives have the right to demand that their screening be suspended.
– If the investigation proves that the information provided distorts reality, relatives of the victims have the right to file a lawsuit in court and demand that materials created for commercial gain be excluded from display and circulation. The expert explained that this is only possible if there is real evidence that a person’s honor and dignity have been harmed.
At the same time, he stressed that the causes of death proven by the investigation are considered strong evidence in court.
– Conspiracy theories surrounding the death of the Dyatlov group concern “who could have killed them and how”. Arguments include pieces of tarpaulin or footprints in the snow. Official documents indicate that they died of frostbite and injuries incompatible with life as a result of the avalanche. The lawyer explained that this allows the families of the victims to refute the facts that appeared in the artistic films and demand either re-filming of the unreliable episode or stopping the show.
Relatives of the deceased tour group also have the right to demand compensation from the film’s creators, Frolov said.
“For example, if people go to court to stop the screening, but the claim is not satisfied, they can demand monetary compensation. The size of the compensation will depend on the royalties of the authors of the film. As practice shows, the payments are large in such cases: if the film grosses billions of dollars, the injured party can count on large payments.”
Relatives of the deceased members of the Dyatlov group are also planning to start a new criminal case, as the case lacks a number of medical examinations that would help restore the picture of what happened.
